Here is what you need to know from stories, research, and data released this week:

  • 529 Insiders, “Status Board: SECURE Act 529 State Updates.” Editor’s Take: Effective April 2022 and per plan disclosure agreement, New York was updated from “Not Allow Student Loans & Not Allow Apprenticeship Withdrawals State Tax Free” to “Not Allow Student Loans & Allow Apprenticeship Withdrawals State Tax Free.” As such, New York was updated to allow qualified 529 distributions from apprenticeships.
  • 529 Insiders, “State by State Overview of Potential 529 Plan State Tax Benefits on Contributions.” Editor’s Take: The status board was updated for Delaware from Tax Neutral State to In-State Tax Benefit per state update here.
  • 529 Insiders, “529 Dash Reader Question.” Editor’s Take: What rules govern how much you can withdraw for food when the student lives off campus?

ABLE accounts are tax-advantaged savings accounts for certain individuals with disabilities and their families.

  • Joint Committee on Taxation, “Description of the Chairman’s Modification to the Provisions of the “Enhancing American Retirement Now (EARN) Act.” Editor’s Take: New legislation titled in short the “Earn Act” and also referenced as SECURE 2.0 is currently on course to include the ABLE Age Adjustment Act which would increase the age of onset for eligibility to open an ABLE account from 26 to 46 years old. ISS Market Intelligence will continue to track and report on the progress of this legislation.
  • ABLE Age Adjustment Act Status Board: The bill would increase the age of onset for eligibility to open an ABLE account from 26 years old to 46 years old. As of July 1, 2022, the bill sponsorship was as follows:
    • Senate (S331): 1 sponsor and 19 cosponsors
    • Congress Sponsorship (HR1219): 1 sponsor and 87 cosponsors
